       21. I understand that if I agree to buy a horse from Miller’s that I can sell the horse but need to notify Miller’s and have the new owners sign a Miller’s agreement.  I cannot sell, trade, lease or give the horse away at any time without notifying Miller’s and filling out a new Miller’s agreement for the new owners.  Moreover, Buyer agrees that if at any time, buyer wishes to relinquish the ownership of the said equine, buyer will contact Miller’s first. Buyer is to offer Seller first right of refusal by making a good faith effort to reach Seller by telephone or by certified return receipt mail to last known address.  Buyer agrees Miller’s has the right to evaluate the sold horse and make send a report with the findings every 6 months.  The horse is not to be sold without contacting Miller’s (as noted above) and to an approved home by Miller’s.  New buyers will have to sign this contract before this horse is to be sold to them. This horse is never to end up in and unwanted place or feedlot, sales auction.  This horse will be returned to Miller’s without charge after she or he is no longer sellable or wanted.

I understand that I am solely responsible for any liability that should occur – be it property damage, personal injury or death.

Agreement

Signing this application authorizes Miller’s (Miller’s Equestrian Center and Sanctuary) to contact the above listed references and inquire about your equine experience.  It is agreed that the said animal will not be offered for sale ever but returned to Miller’s free of charge when no longer wanted or useable.  Miller’s will come and view the horse twice a year to assure good treatment and conditions.  Adopters are to make changes as suggested by Miller’s in the case of proper care of the animal.  Miller’s needs to be notified by the owner if the animal has a serious injury or dies.  Miller’s may help out with injuries or conditions that are life threatening.  Ginger is being adopted out with a notification of  BREEDING Clause, she is for Trail riding or Western/English Pleasure only, no roping or barrels or excessive work.

In the event the undersigned fails to comply with the terms of this Application and Agreement, Miller’s reserves the right to commence legal proceedings to recover the horse, and the undersigned shall be liable for all costs, inclusive of attorney’s fees, in connection with such legal proceeding.
